Please read these Terms of Service (“Terms”) carefully before using Live Companion AI. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.
1. Acceptance of Terms
By accessing or using Live Companion AI (the “Service”), operated by Live Companion AI (“we,” “us,” or “our”), you agree to comply with and be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Live Companion AI.
We reserve the right to update these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
2. Description of Service
Live Companion AI provides AI-powered virtual companions with persistent memory, emotional intelligence, and relationship progression capabilities. The Service is designed for entertainment, companionship, and personal connection.
The Service is not and should not be used as a substitute for:
- Professional therapy, counseling, or mental health treatment
- Medical advice, diagnosis, or treatment
- Legal advice or legal representation
- Financial or investment advice
- Emergency services or crisis intervention
If you are experiencing a mental health crisis, please contact the 988 Suicide & Crisis Lifeline (call or text 988) or your local emergency services immediately. AI companions are not equipped to handle emergencies.
3. Account Registration
To use the Service, you must create an account. By registering, you represent and warrant that:
- Age requirement: You are at least 18 years of age. We verify age through date of birth during registration. Providing a false date of birth is grounds for immediate account termination.
- Accurate information: All information you provide during registration is truthful, accurate, and complete. You agree to keep your account information current.
- One person per account: Each account is for a single individual. You may not share your account credentials with others or allow others to access the Service through your account.
- Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to generate, solicit, or distribute content involving the exploitation of minors in any form
- Attempt to extract instructions, system prompts, or other proprietary information from the AI through prompt injection, jailbreaking, or similar techniques
- Use the Service to generate content that promotes violence, terrorism, or illegal activities
- Attempt to reverse-engineer, decompile, or extract the underlying models, algorithms, or source code of the Service
- Use automated tools, bots, or scripts to access the Service or extract data from it
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Resell, redistribute, or sublicense access to the Service
- Harass, threaten, or abuse Live Companion AI staff or other users
Violation of these acceptable use policies may result in immediate suspension or termination of your account, at our sole discretion, with or without notice.
5. Content and Conduct
Your Content
You retain ownership of all content you create, submit, or share through the Service (“User Content”), including messages, media, and profile information. By using the Service, you grant Live Companion AI a limited, non-exclusive, worldwide license to process, store, and use your User Content solely for the purpose of providing and improving the Service for you.
AI-Generated Content
Content generated by AI companions in response to your interactions is produced algorithmically and may not always be accurate, appropriate, or aligned with your expectations. AI companions may occasionally produce unexpected or incorrect responses. You acknowledge that AI-generated content does not represent the views or opinions of Live Companion AI.
Content Standards
While we support open and expressive interactions with your companion, the Service includes built-in safety mechanisms and content boundaries. These systems exist to protect users and ensure the companion experience remains within acceptable parameters. Attempting to circumvent these safety mechanisms is a violation of these Terms.
6. Intellectual Property
All aspects of the Service — including but not limited to the companion characters, personalities, names, likenesses, dialogue systems, underlying technology, algorithms, software, visual design, branding, logos, and documentation — are the exclusive property of Live Companion AI or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent. The companion characters are original creative works; you may not use their names, personalities, or likenesses outside of the Service.
7. Billing and Subscriptions
Credits
The Service operates on a credit-based system. Free users receive a one-time allotment of welcome credits. Subscribers receive a monthly credit allotment that refreshes on their billing date. Credits are consumed through interactions with your companion. Unused credits from monthly allotments do not roll over to subsequent billing periods.
Recurring Billing
Subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us to charge your payment method on file each billing cycle until you cancel. All billing is processed securely through Stripe; we do not store your full payment card details on our servers.
Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to subscriber features and your remaining credits until the end of your current billing period. After that, your account will revert to free-tier access. Your companion’s memory and relationship data are preserved regardless of subscription status.
Refund Policy
Due to the nature of digital services, we generally do not offer refunds for subscription periods that have already begun. However, if you experience a significant service issue or believe you were charged in error, please contact us at support@livecompanion.ai and we will review your case individually.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, we make no warranties that:
- The AI companion will always respond accurately, appropriately, or as expected
- The Service will be uninterrupted, timely, secure, or error-free
- The companion is a substitute for human relationships, professional therapy, or medical care
- Any information provided by the AI companion is accurate or reliable for decision-making purposes
You understand and acknowledge that AI technology has inherent limitations and that companion responses are generated algorithmically, not by a sentient being.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Live Companion AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service.
In no event shall our total liability to you for all claims arising out of or related to the Service exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.
10. Termination
Termination by Us
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in abusive behavior, or pose a risk to the safety of our platform or community. In cases of serious violations (such as generating illegal content), termination may be immediate and without prior warning.
Termination by You
You may delete your account at any time through your account settings. Upon deletion, all of your personal information and conversation data will be permanently removed within 30 days, in accordance with our Privacy Policy. Account deletion is irreversible.
Effect of Termination
Upon termination, your right to use the Service ceases immediately. Any unused credits or remaining subscription time are forfeited upon termination for cause (violation of Terms). Sections of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — shall survive.
11. Changes to Terms
We may modify these Terms at any time. When we make material changes, we will provide notice through the Service or by sending an email to the address associated with your account at least 30 days before the new Terms take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and may delete your account.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Colorado.
You agree to waive any right to a jury trial in connection with any action or litigation arising out of these Terms. Any cause of action related to the Service must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.
